INSTRUCTION : TWO COMPULSORY QUESTIONS
QUESTION 1
Section 318 (1b) of the Cameroon penal code of 2016 clearly stipulates that : "whoever causes loss to another by misrepresentation, that is, by destruction, waste or conversion of any property capable of being removed and which was entrusted to him For the purpose of custody, return, accounting or any particular manner of dealing" shall be punished. Discuss (10mks)
Question 2
On the 12th of June, Mr Opandada, a businessman arrived the Douala International Airport. After checkout, he hired a taxi from the airport to "Fulawa Hotel" situated in the heart of Bali. There, Mr Opandada was lodged in a room worth 25000CFA a day.
While in the hotel, Mr Opandada benefited from the restaurant services where he ate and drank during his stay there. Mr Opandada spent nine nights without any problem.
On the 21st of June 2016, a Bill of 425,000frs was presented to Mr Opandada. Mr Opandada after receiving the bill requested for an explanation of the amount of the bill. The hotel servant replied that lodging is 225,000frs while restauration service is worth 200,000frs. When put together, say 225,000frs + 200,00frs =425,000frs.
Mr Opandada acknowledged the bill of 425000frs but replied that he lost his luggage in the flight he took from Britain to Cameroon that contained all the pounds and cheques he had.
Mr Opandada father was informed of this unfortunate situation and he quickly went to his sister in law who was head of the judicial police station in Bonanjo to find out the following questions :
